Realwobbler Handmade Fishing Lures Online Boutique (“Realwobbler/ realwobbler.com/ we/ us/ our“) provides products and services to its customers (“you/ your/ customer/ recipient”) subject to the notices, Terms and Conditions of Use set forth in this agreement (the "Agreement").

1.1 You represent and warrant that you are at least 18 years old or visiting the Site under the supervision of a parent or guardian.
1.2 Subject to the terms and conditions of this Agreement, we hereby grant you a limited, revocable, non-transferable and non-exclusive license to access and use the Site by displaying it on your internet browser only for the purpose of shopping for personal items sold on the Site and not for any commercial use or use on behalf of any third party, except as explicitly permitted by us in advance. Any breach of this Agreement shall result in the immediate revocation of the license granted in this paragraph without notice to you.
1.3 Except as otherwise provided elsewhere in this Agreement or on the Site, anything that you submit or post to the Site and/or provide us, including without limitation, ideas, know-how, techniques, questions, reviews, comments, and suggestions (collectively, "Submissions") is and will be treated as nonconfidential and nonproprietary, and we shall have the royalty-free, worldwide, perpetual, irrevocable and transferable right to use, copy, distribute, display, publish, perform, sell, lease, transmit, adapt, create derivative works from such Submissions by any means and in any form, and to translate, modify, reverse-engineer, disassemble, or decompile such Submissions. All Submissions shall automatically become our sole and exclusive property and shall not be returned to you.
In addition to the rights applicable to any Submission, when you post comments or reviews to the Site, you also grant us the right to use the name that you submit with any review, comment, or other Content, if any, in connection with such review, comment, or other content. You represent and warrant that you own or otherwise control all of the rights to the reviews, comments and other Content that you post on this Site and that use of your reviews, comments, or other Content by us will not infringe upon or violate the rights of any third party. You shall not use a false e mail address, pretend to be someone other than yourself or otherwise mislead us or third parties as to the origin of any Submissions or Content. 3. PRODUCT SPECIFICATIONS AND AVAILABILITY
3.1 We make all reasonable efforts to accurately display the attributes of our products; including sizes, measurements, materials, and descriptions. Please note that the product information provided are approximated and provided for convenience purposes only. The color you will see on the Site will depend on many factors, including your computer, which we cannot guarantee will accurately display the correct colors. All features, specifications, products, prices of products and services, discounts, promotions and offers described are subject to change at any time, and Realwobbler Handmade Fishing Lures Online Boutique reserves the right to make changes to them without prior notice to you.
3.2 The inclusion of any products or services on the Site at a particular time does not imply or warrant that these products or services will be available at any time. Realwobbler reserves the right to limit the order quantity on any product and/or to refuse to ship product to any customer for any reason, or for no reason whatsoever, with or without prior notice.
3.3 In the event that an item is listed at an incorrect price (e.g., due to typography error), we shall have the right to refuse or cancel any order placed for the incorrect price, regardless of whether the order is being or has been processed. If payment has already been made or if your account has already been charged for the purchase and the order is cancelled, we shall credit your account in the amount of the incorrect price.
3.4 Products are available while stock last.
3.5 The measurement units of meters and grams are the correct ones. Other measurement units, (ounce, inch, etc.) are provided for customer's convenience purposes only; the customer is responsible for the right conversion of the measurement units.
4.1 Order processing and contacting usually takes place via automated order processing. It is your responsibility to ensure that the e-mail address you provide for the order processing is accurate so that e-mails sent by realwobbler.com can be received at this address. Particularly, it is your responsibility, if SPAM filters are used, to ensure that all e-mails sent by us or by third parties commissioned by us with the order processing can be delivered.
4.2 Your order will only be processed if accompanied by full payment. Once we receive your order we will automatically send you an e-mail confirming your order details. This e-mail shall be directed to the email address you supplied us upon your order.
4.3 By clicking on the Checkbox “I agree to the Terms and Conditions of Use and will adhere to them unconditionally“, you are consenting to be bound by this Agreement.
4.4 In extreme circumstances, some orders cannot be fulfilled on the same or the next day for reasons beyond our control. On these occasions you acknowledge that delivery will be completed as soon as possible after the order is placed.
5.1 We deliver to the following countries:
Europe EU: Austria, Belgium, Cyprus, Czech Republic, Denmark, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Liechtenstein, Luxembourg, Malta, Netherlands, Poland, Portugal, Slovakia, Slovenia, Spain, Sweden, United Kingdom.
Europe Out EU: Andorra, Gibraltar, Greenland, Iceland, Monaco, Norway, San Marino, Switzerland, Vatican City State.
North America: Canada and United States.
Oceania: Australia and New Zealand.
Asia: Japan.
5.2 Shipping is free for orders from 100.00 € to all countries that we deliver to. It is handled by Bulgarian Post (Registered Priority Mail International).
Shipping costs for orders inferior to 100.00 € are:
- EU-Countries and European Out EU-Countries: 5.90 €.
- US, Canada and other Countries: 7.00 €
Shipping is handled by Bulgarian Post (Registered Priority Mail International).
5.3 Shipping takes between 6 to 20 working days for EU Countries, and between 7 to 23 working days for Non-EU-Countries.
Please note that these delivery times are provided for information purposes only and can not be guaranteed by us. Our guarantee is for delivery of 60 days.
Products are delivered only during the 5 working days in the week (no deliveries will be made during the weekends or on bank holidays).
5.4 Realwobbler Handmade Fishing Lures Online Boutique shall not be liable for any delay in delivery of the products howsoever caused up to 60 days from the shipping date.
5.5 In order to ensure that products arrive in perfect condition and are protected during transport, all products are carefully packed. You should check the packaging and the products at the time of delivery.
5.6 Upon receipt of your package, it is your duty to check it. Any anomaly in the delivery must be indicated in writing to the email address info@realwobbler.com within 48 hours (including holidays) after delivery (as per postmark). No claims will be accepted after this period.
Should you authorize a third party to receive your package, it is your duty to inform the other person of this part of the Agreement.
5.7 If more than 45 working days have passed since you placed your order and you haven't received your package, please contact us and we will raise a full investigation with our courier to confirm with them that the parcel has indeed been lost.
Once we can confirm this, we can either refund you or re-dispatch your order (stock willing).
Please note that due to the uniqueness of the Realwobbler fishing lures, in the case of a loss, we cannot be held responsible for the inability to re-dispatch exactly the same fishing lures. However, by stock availability we will ensure that the substitution products supplied will be as similar as possible (e.g. in model, skin type and size) and of equal or higher quality and value to those originally sent, at no extra charge.
Please take into account that this guarantee is available for countries we usually deliver to (Point 5.1). For deliveries to other countries, should delivery be possible, Realwobbler will only take responsibility for damages or losses caused by the post office of Bulgaria; the risk of the postal services outside the territory of Bulgaria shall be born by the buyer.
5.8 Should the assigned transport company return the goods to the premises of Realwobbler Handmade Fishing Lures Online Boutique, because delivery to you was not possible, the fee for unsuccessful delivery, as well as charges for the refund process (i.g. fees for bank wire transfer for non-EU-Countries) will be deducted from reimbursement of product's costs. This shall not apply if you hereby exercise your right of cancellation and have previously informed us in written via e-mail and have received a confirmation e-mail from us that you wish to cancel your order.
If you want us to send the package again to you, you agree to pay the correspondent shipping fees.
5.9 In the case of International shipping for non-EU Counties the recipient is the importer of record and must comply with all laws and regulations of the destination country. Orders shipped outside of the European Union may be subject to import taxes, customs duties and fees levied by the destination country. The recipient of an international shipment may be subject to such import taxes, customs duties and fees, which are levied once a shipment reaches the recipient's country. Additional charges for customs clearance must be borne by the recipient. Please consider that we have no control over these charges and can't predict what they may be. Customs policies vary widely from country to country; you should contact your local customs office for more information. When customs clearance procedures are required, it can cause delays beyond our original delivery estimates.
The weight of the packages we ship vary depending on their content, but they do not exceed two kilograms.
5.10 We would like our international customers (non-EU Countries) to be aware that cross-border shipments are subject to opening and inspection by customs and/or postal authorities.
Also, we may provide certain order, shipment, and product information, such as titles, to our international carriers, and such information may be communicated by the carriers to customs and/or postal authorities in order to facilitate customs clearance and comply with local laws.
5.11 It is your responsibility to ensure that you personally or a person of trust receives the package at the provided by you during the order process or registration on our website address. Realwobbler Online Boutique Fishing Lures can not be held responsible if you provide an address where untrustworthy person/s are located, and they receive your package but do not hand it over to you.
6. CANCELLATION AND RETURN POLICY
6.1 Realwobbler Handmade Fishing Lures Online Boutique wants you to be totally satisfied with your fishing lures. However, if you would like to cancel your order and return the lures you may do so by notifying us in writing by e-mail to info@realwobbler.com. You can return goods you have ordered from our online boutique for any reason at any time within 30 days of receipt for a full refund or exchange. This term varies for items bought on auctions. You will be able to find the term in this case in the auction description.
6.2 You must take reasonable care of the goods and return them to us in their original conditions: undamaged, in the original packaging and free gifts included, if applicable. We will not consider that reasonable care of the goods has been token if they have been used in a way, or to an extent, beyond what would be reasonable when examining them in a shop before purchase.
6.3 The costs of returning goods to us shall be borne by you.
6.4 The risk of lost or damage during the transport shall be borne by you.
6.5 If you wish to cancel your order from our online boutique you may do so starting from the time you place the order and ending on the expiry of 30 days starting from the day after the goods have been received (as per postmark). Please note that we do aim to dispatch items as soon as possible as the order is placed and it may be possible that your item has already dispatched if the cancellation is not made immediately after purchase. In such case, the cancellation will be considered a return of the products in accordance with Point 6.1-6.4 of this Agreement.
6.6 Realwobbler reserves the right to make a charge for the costs of recovery and subtract the shipping expenses from the purchase amount, in case that you return the goods at our expense.
6.7 However, the Cancellation and Returns Rights do not apply to personalized products and to both VIP Tickets.
The fee of the VIP Tickets is non-refundable, unless the delivery time exceeds 2 months. In such case, we will notify you about the expected delivery date and you will be able to choose either to wait or to cancel your order for a full refund.
7. PAYMENT METHODS AND CURRENCIES
There are various payment methods available for different countries; you can find them all below:
- PayPal - available in all countries that we usually deliver to (Point 5.1), except for Bulgaria.
When you select PayPal as your payment method, you are redirected to the PayPal website. Log in to PayPal and follow the instructions to complete your purchase. If you've never used PayPal before, you’ll need to create a PayPal account. Click Create a PayPal Account, enter your details, then click Continue.
When you’ve paid with PayPal, your payment details will be securely stored and your payments will be much quicker in the future.
Our main currency is Euro, but in order to facilitate payments to foreign customers we can also accept the following currencies: British Pounds and U.S. Dollars. Please note, that the correspondent prices in these currencies may vary according to the exchange rate to the Euro currency.
Whilst we agree to use our reasonable endeavors to ensure that the Realwobbler Handmade Fishing Lures Online Website is fully operational and error-free, we cannot guarantee that this will always be the case. We therefore accept no responsibility or liability for any defects or interruption of our service.
We shall be released from our obligations under this Agreement in light of any event beyond our reasonable control, (i.e.: civil commotion, flood, fire, drought) which renders the provision of the Realwobbler Online Site impossible or impractical.
We exclude all liability for any claims, losses, demands and damages, including without limitation, any costs, loss of profits, loss of contracts or business opportunity, loss of data and any other consequential, incidental, special or punitive damages, even if we have been advised of the possibility of such damages, arising directly or indirectly out of or in any way connected with your use or inability to access the Realwobbler Handmade Fishing Lures Online Boutique Website, whether arising in contract, tort (including negligence), under statute or otherwise provided that nothing contained in these Terms and Conditions affects or will affect you or the recipients statutory rights in relation to the quality, fitness or description of the Realwobbler Online Products supplied.
We reserve the right to supplement and amend this Agreement at any time. It is your responsibility as a customer to review the Terms and Conditions of Use on each occasion you access the Site. Changes will be effective immediately after the posting of any such change and all subsequent dealings between you and us shall be on the new Terms and Conditions.
Additionally, we reserve the right to suspend, restrict or terminate access to the Realwobbler Online Site for any reason at any time.
We shall ensure that we comply with the requirement of all current data protection legislation. We shall only use personal data received from you for the purpose of fulfilling your order.
Your purchase will be deemed to have occurred in Bulgaria. These Terms and Conditions shall be governed by and construed in accordance with Bulgarian Law and the parties agree to submit to the exclusive jurisdiction of the Bulgarian courts.
